1. Who we are

References to "Bemodo", "we", "us" or "our" in these Terms & Conditions mean MB INT. LLC.

These Terms & Conditions apply to all orders placed through the Website by consumers in the United Kingdom. Please read them carefully before placing an order. By placing an order, you confirm that you accept these Terms & Conditions.

Nothing in these Terms & Conditions affects your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable law.

2. Placing an order and how the contract is formed

  1. To place an order, add the products you wish to purchase to your basket, proceed to checkout, enter your delivery and payment details, review your order, and click the button to confirm and pay. Before submitting your order, you can review and correct any input errors on the checkout page.
  2. After you place your order, you will receive an email acknowledging that we have received it. This acknowledgement is not acceptance of your order.
  3. A binding contract between you and us is formed only when we send you an email confirming that your order has been dispatched (or, for digital content, when we make the content available to you).
  4. We may decline or cancel an order before dispatch, for example if a product is unavailable, if we identify a pricing or description error, or if we cannot verify your payment. If we do so, we will notify you and refund any payment taken in full.
  5. The contract is concluded in English. A copy of your order details will be sent to you by email; we recommend that you keep it for your records.

3. Products

  1. We take care to display and describe our products as accurately as possible. However, images are for illustration only and minor variations (for example in colour due to screen settings) may occur.
  2. All products are subject to availability.

4. Prices and payment

  1. All prices shown on the Website are in pounds sterling (GBP) and include UK VAT where applicable.
  2. Delivery to the United Kingdom is free of charge. Any exceptions would be clearly displayed at checkout before you place your order.
  3. For orders with a total consignment value of £135 or less, UK VAT is charged by us at checkout and no further tax is payable on delivery. For orders above £135, import VAT and any applicable customs duties may be payable; where this is the case, it will be made clear to you before you complete your order.
  4. Payment is taken at the time you place your order. We accept the payment methods displayed at checkout.
  5. If we discover an obvious pricing error, we are not obliged to supply the product at the incorrect price. We will contact you and give you the option of confirming the order at the correct price or cancelling it with a full refund.

5. Delivery

  1. We deliver to addresses in the United Kingdom. Orders are dispatched from our fulfilment centre in the European Union.
  2. Estimated delivery time is 7–14 days from dispatch. Delivery timescales are estimates and not guaranteed, but we will deliver your order without undue delay and in any event within 30 days of the contract being formed, unless we agree a different date with you.
  3. If we fail to deliver within the agreed time and a replacement deadline you set is not met, you may cancel the order and receive a full refund.
  4. The products become your responsibility (risk passes to you) once they have been delivered to the address you provided. Ownership passes to you once we have received payment in full.

6. Your right to cancel (cooling-off period)

As a UK consumer buying at a distance, you have a legal right to cancel your order without giving any reason within 14 days after the day on which you (or a person you nominate) receive the goods. Full details of this right, how to exercise it, the return procedure, the return address and a model cancellation form are set out in our Refund & Cancellation Policy, which forms part of these Terms & Conditions.

Please note: you are responsible for the direct cost of returning the goods if you cancel under this right. Details are in the Refund & Cancellation Policy.

7. Digital content – loss of the right to cancel

Where you purchase digital content that is not supplied on a physical medium (for example downloadable files, e-books or online content):

  1. The 14-day cancellation right applies in principle. However, if you request that the digital content is made available to you immediately (i.e. within the 14-day cancellation period), you will be asked at checkout to give your express consent to immediate supply and to acknowledge that you thereby lose your right to cancel once the download or streaming has begun.
  2. If you do not give this consent, the digital content will be made available to you only after the 14-day cancellation period has expired.

8. Faulty products – your statutory rights

Under the Consumer Rights Act 2015, products must be of satisfactory quality, fit for purpose and as described. If they are not:

  • Within 30 days of delivery, you may reject faulty goods and receive a full refund.
  • After 30 days and within 6 months of delivery, you are entitled to a repair or replacement; if that fails, you may claim a refund or price reduction. Faults appearing in this period are presumed to have existed at delivery unless we can show otherwise.
  • These rights are in addition to, and unaffected by, the 14-day cancellation right and our Refund & Cancellation Policy.
  • Digital content must also be of satisfactory quality, fit for purpose and as described. If faulty, you are entitled to repair or replacement, and if that is not possible, a price reduction.

If a product is faulty, we will also cover the reasonable cost of returning it. Please contact us at office@bemodo.uk before returning faulty goods so we can arrange this with you.

9. Our liability

  1. Nothing in these Terms & Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.
  2. We are responsible for foreseeable loss or damage caused by our breach of these Terms & Conditions or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses, as we supply products for private consumer use only.

10. Personal data

We process your personal data in accordance with our Privacy Policy and our Cookie Policy, both available on the Website.

11. Complaints and dispute resolution

  1. If you have a complaint, please contact us at office@bemodo.uk. We aim to respond within 5 working days and to resolve complaints fairly and promptly.
  2. If we cannot resolve a dispute, you may be able to use alternative dispute resolution (ADR). We are not obliged to participate in ADR but will inform you of a relevant certified ADR provider on request.
  3. You always have the right to bring proceedings before the courts (see clause 13).

12. General

  1. We may update these Terms & Conditions from time to time. The version published on the Website at the time you place your order applies to that order.
  2. If any provision of these Terms & Conditions is found to be invalid, the remaining provisions remain in full force.
  3. The contract is between you and us; no third party has rights under it.

13. Governing law and jurisdiction

These Terms & Conditions and any contract between us are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you also benefit from any mandatory consumer protections of the law of your home country. You may bring legal proceedings in the courts of England and Wales or, if you live in Scotland or Northern Ireland, in the courts of your home country.
